Road Traffic Accident: Gathering Information for Your Claim

When submitting a claim for personal injury compensation, the information you will provide and that we will collect during your FREE Claim Assessment interview, can go a long way in speeding your claim. Do not worry if you do not have at hand all the information listed below. The list we have compiled is for information purposes.

1) Information about the parties involved

We will need to gather information about the parties involved in the accident. This includes your personal information and that of any other parties involved. If you do not have the details of the other party (if for example you were the victim of a hit and run accident) you may still be able to claim compensation through the Motor Insurers Bureau.

2) Information about the accident

This will include where the accident took place, what happened, what you were doing at the time of the accident (i.e. your circumstances), whether you were driving, walking or cycling. We will also need to know whether the police attended the scene of the accident and if so if you were given an incident report or number. This will be useful to your solicitor in gathering information from an independent source. The Police will in most cases interview the parties involved in the accident and any potential witnesses. In some cases it would be useful for you to make a simple drawing of the accident itself.

3) Information about any witnesses

Witnesses to an accident can be important in establishing who was at fault and therefore prove that the other party was negligent (for example if they were going too fast or were talking on their mobile phone). If you have signed witness statements or if you have the personal details of anyone who witnesses the accident, do let us know.

4) Information about your injuries

In evaluating how much compensation you will be entitled to get, your solicitor and the courts or insurance company will consider the extent and type of your injuries, whether they resulted in long term disabilities. The compensation you will receive is to make up for any losses you have incurred as a result of your accident. The compensation will therefore also take into account whether you have had to take time off work. Any supporting medical evidence will be useful together with the contact details of the surgery, hospital or doctor who firt diagnosed or cared for your injuries.

5) Any other information

If you were the driver of a vehicle, your insurance might include Legal Expense insurance which might give you more options for funding your case. If you are able to provide information as to the terms of the cover you have, your solicitor will be able to advise you on the best course of actiuon given your circumstances. Your solicitor will also need to know whether you are receiving any benefits from the government that are related to your accident and injuries.

Road Traffic Accident: Using the Information You Provide

When you contact Accident Compensation 4 U, you will be interviewed and we will try and collect as much of the information above as possible. This information is then passed on to a Forum Law solicitor who will evaluate:

  • whether you have a valid claim for compensation and whether the claim has a chance of succeeding. In some cases your appointed solicitor will advise you that in their opinion your claim is not worth pursuing as it would be more costly than the compensation you are likely to receive.
  • how much compensation you are likely to be awarded. As your claim progresses the insurance company involved will probably try and settle the claim out of court. At every stage of the claiming process your appointed solicitor will advise whether the offers that are made are worth considering.
  • how your claim can be funded. Accident Compensation 4 U runs an extended Conditional Fee Agreement (also called a No Win No Fee agreement) which ensures that WIN OR LOSE you will never be responsible for any legal expenses or disbursements.
