Gathering Information for Your Claim
Understanding the Claim Process
Accident At Work: Gathering Information for Your Claim
During the FREE assessment stage of the claiming process, we will gather some initial information that will enable your solicitor to evaluate:
- Whether your claim is worth pursuing i.e. whether you have a case. This will ultimately be your choice, although your solicitor will chose whether they are able to take your case on.
- How much compensation you are likely to get, based on your circumstances and similar cases. Every accident and injuries are unique, however through experience and government guidelines, your solicitor will be able to provide you with an idea of how much compensation you are likely to get.
- How your claim will be funded. Accident Compensation 4 U works with solicitors that offer a NO WIN NO FEE agreement where you will not have to pay anything. If you are a member of a Trade Union however or have Legal Expense Insurance, you might have alternative options.
While it would be useful, not all the information below is required. Compiling it, however, will help to speed the process of claiming compensation.
- The date of your accident to ensure that your accident has happened within the prescribed three year time limit for claims.
- Your personal details including your national insurance number.
- Your employer's details.
- A description of your accident.
- Information about any training you might have received as part of your job.
- A description of your injuries and whether you had any previous condition that was present when you had your accident.
- Details of the doctor, surgery or hospital that you have first visited after your accident.
- Details of any witnesses that were present when your accident happened.
As a general rule of thumb it is a good idea to gather all this information and keep it in a folder so that it can quickly be accessed. In addition to the above, your solicitor will want to know:
- Whether you have copies of your company's accident record book.
- Whether you are receiving any benefits such as Statutory Sick Pay or Disability Benefit.
